These Terms of Service govern your use of our chat models, image models, and other services provided by PPQ.AI, including any related software applications and websites (collectively, "Services"). By accessing or using our Services, you agree to comply with these Terms.

Use of Our Services

Permitted Use

You may access and utilize our Services as long as you adhere to these Terms and all applicable laws. You must also follow PPQ.AI's policies, including our Sharing & Publication Policy, Usage Policies, and any other guidelines we provide.

Prohibited Use

You are prohibited from engaging in any activities that are illegal, harmful, or abusive while using our Services. Specifically, you may not:

• Infringe upon or violate the rights of others.
• Modify, copy, sell, lease, or distribute any part of our Services.
• Attempt to reverse engineer, decompile, or extract source code or underlying components.
• Use automated methods to collect data or generate output, such as for training other AI models.
• Misrepresent AI-generated content as being created by a human.
• Bypass security measures, rate limits, or protections implemented in our Services.

Access & Eligibility

To use our Services, you must be at least 13 years old or meet the minimum age requirement in your country. Users under 18 require consent from a parent or legal guardian.

Content

User-Provided Content

You may provide input to our Services ("Input") and receive output based on that input ("Output"). Together, Input and Output constitute "Content." You are responsible for ensuring your Content complies with applicable laws and these Terms.

Ownership of Content

As between you and PPQ.AI, you retain ownership of your Input, and any Output generated for you belongs to you, subject to applicable laws. However, due to the nature of AI, similar output may be provided to multiple users, and ownership does not extend to outputs received by others.

Accuracy of Output

AI-generated content may not always be accurate or reliable. You acknowledge that:

• Output should not be used as a sole source of factual information.
• You must review and validate Output for accuracy before using or sharing it.
• Output should not be used to make significant decisions affecting individuals (e.g., employment, credit, or legal matters).
• PPQ.AI does not endorse any third-party products or services that may be referenced in Output.

Intellectual Property

PPQ.AI and its affiliates retain ownership of all intellectual property rights related to the Services.

Accounts & Data Handling

Account Creation

Creating an account is optional but may grant access to additional features, such as storing conversations and images.

Data Storage & Deletion

• When using our service without an account, your conversational data is stored locally on your device.
• If you create an account, your conversational data and email will be stored with us.
• Deleted data is permanently removed, and deleted accounts erase all stored information.
• Accounts inactive for over one year may be deleted.

Payments & Withdrawals

Our Services operate on a pay-per-use model with prepaid accounts. Users may deposit funds using cryptocurrency or credit card payments. Deposited funds are non-withdrawable, except in cases of mistaken transactions or service-related issues, subject to review.

We reserve the right to adjust pricing. If you disagree with any pricing changes, you may discontinue using our Services and withdraw any remaining balance.

Service Termination & Suspension

You may stop using our Services at any time. We reserve the right to suspend or terminate access if:

• You violate these Terms.
• We are required to do so by law.
• Your use of the Services presents a risk to us, our users, or others.

If you believe your account was suspended or terminated unfairly, you may file an appeal by contacting matt@ppq.ai.

Discontinuation of Services

We may discontinue or modify our Services, in which case we will provide advance notice and refunds for any prepaid, unused Services.

Disclaimers & Limitations of Liability

Service Availability

Our Services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. Your use of Outputs is at your own risk.

Liability Limitations

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages.
• Our maximum liability is limited to either the amount paid for the relevant Service in the last 12 months or $100, whichever is greater.
• Some jurisdictions do not allow certain warranty disclaimers or liability limitations, so parts of this section may not apply to you.

Indemnification

If you are a business or organization, you agree to indemnify PPQ.AI and its affiliates from any claims, costs, and liabilities arising from your use of our Services or Content.

Dispute Resolution

Arbitration Agreement

All disputes arising under these Terms will be resolved through final and binding arbitration. Before filing a formal claim, both parties agree to attempt informal resolution by contacting matt@ppq.ai.

Exceptions & Class Action Waiver

• Small claims and intellectual property disputes are exempt from arbitration.
• Disputes must be resolved individually—class actions and representative claims are not permitted.
• If part of this arbitration agreement is found invalid, the rest remains in effect.

Copyright Infringement Claims

If you believe your intellectual property rights have been violated, please contact matt@ppq.ai with the following details:

• Your contact information.
• A description of the copyrighted work.
• A description of the infringing material and its location.
• A statement affirming your good-faith belief that the use is unauthorized.
• A declaration, under penalty of perjury, that your claim is accurate and that you have the right to act on behalf of the copyright owner.

General Terms

Assignment

You may not transfer your rights or obligations under these Terms without our consent. We may transfer our rights or obligations to an affiliate, subsidiary, or successor.

Changes to These Terms

We may update these Terms periodically due to legal, security, or business considerations. Changes take effect upon posting. Continued use of the Services after changes constitutes acceptance.

Enforceability

Failure to enforce any provision is not a waiver of our right to do so later. If any part of these Terms is found invalid, the remainder remains enforceable.

Compliance with Trade Laws

You must comply with applicable trade and export laws. Our Services cannot be used in embargoed regions or by restricted individuals.

Entire Agreement

These Terms represent the full agreement between you and PPQ.AI regarding your use of the Services, superseding any prior agreements.

By using our Services, you acknowledge and agree to these Terms.
